e-Statement Terms and Conditions
Terms and Conditions eStatement Agreement (?Agreement?) : Customer must be an account owner on all accounts they wish to access electronically.
In consideration of the e-Statement Program (?Program?) to be provided by Consumer Portfolio Services, Inc. (?CPS?) as described from time to time in information distributed by CPS to its customers, the undersigned customer(s) of CPS (?you? or ?yours?) agree(s) as follows:
General. You hereby request and authorize CPS to send notice of regular periodic account statement(s) and any required account disclosures to you in electronic format for all accounts designated in this agreement. You understand that you will be responsible for viewing your account statement(s) and disclosures through your Consumer Portfolio Services, Inc. online account, and that by entering into this Agreement, you will no longer receive paper account statements.
Program Requirements. You hereby affirm and agree that you have access to the following computer hardware and software, which are necessary for the operation of this Program:
CPS will notify you of any material change in hardware or software required for retrieving or storing account statements or disclosure information. If such changes render you unable to access the Program, you may cancel your participation in the Program immediately by terminating this Agreement as outlined below. There will be no charge for such termination.
Disclosures. Federal law requires that we obtain your consent before providing required account disclosures electronically. To receive your periodic statements online, you must consent to receive any required disclosures electronically.
Termination. You may terminate this Agreement at any time. There are no fees associated with revoking this Agreement. CPS may also terminate this Agreement at any time and for any reason without advance notice to you. Termination of this Agreement will result in CPS mailing your paper account statements and disclosures to the address CPS has on file.
Operation of Online Account Statement Program. CPS will send you an email notification each month to the email address you provide. The notification will inform you that your statement and required disclosures are available online.
Following the notification, you will be able to access your account statement by logging on to Online Access via the CPS website, consumerportfolio.com. Your account statement will be posted at the CPS website for 36 months after CPS emails you the notification that it is available. You are responsible for printing or downloading copies of your statement for your permanent records. If you require a copy of your account statement after the 36-month period has ended, you must follow the procedure described for obtaining a paper copy below.
Online Fees and Charges. CPS does not charge for the use of Online Access. Should you not logon to Online Access for a 90 day period your Online Access account will be considered inactive. If your Online Access account remains inactive for 180 days re-enrollment in Online Access is required.
Email Address Access and Changes. You agree to maintain a valid email address to receive the account statement notifications. You agree to notify CPS immediately if you are unable to access any of the information that has been delivered by CPS in an electronic form or manner. You can update your email address by logging into Online Access, contacting us at 888.469.4520, or by visiting our website consumerportfolio.com.
For Account Statements. A valid email address and active Online Access account are required to receive your account statements electronically. If your Online Access account is inactive or your email address is invalid you will be unenrolled from receiving your statements online and you will begin receiving paper statements.
Paper Copy Procedure. You have a right to obtain a paper copy of any of the above described disclosures or online account statements. To obtain a paper copy, you must call our Customer Service Center at 888.469.4520.
Liability. CPS will not be responsible or liable for consequential or incidental damages for CPS?s performance under this Program, damages arising from unauthorized access to the Online Account Program, damages arising from your inability to access your online account statement, including computer, email or Internet malfunctions, or any costs associated with updating, modifying or terminating your software or hardware.
Confidentiality. You agree to maintain the confidentiality and security of your online CPS account, and you agree that security procedures are commercially reasonable.
I have reviewed this Agreement, understand the terms and conditions set forth herein, and agree to be bound hereby.
